Many of our clients will smugly tell us that the prosecutor has to dismiss the case because the officer never saw him committing the crime, which is a misdemeanor. The client is retaining our services just to notify the prosecutor (and maybe the judge they think) of this law, which the client is quite certain he or she knows, but the prosecutor may not.
