Do Anti-Immigrant Comments by Judge Invalidate Sentence?

A fundamental principle throughout our legal system is fairness.  The judge is supposed to provide leadership on this issue by being respectful to everyone and in turn, the prosecutors and court room staff are supposed to follow the example.  If a judge makes anti-immigrant comments in sentencing someone who might be seen as an immigrant, does this conduct mean the sentence is unfairly harsh?  Click on the following link to read about a case where this happened.
