Do Presentence Custody Credits Apply to Time at Patton?

The answer to the question posed in the title is “it matters.”  What does matter in determining whether such time does apply?  In a nutshell, it matters how time at Patton was ordered – either as three years, as the lower of two sentences, or as the maximum term of commitment if the person did not have mental issues.  This makes sense, one might say, because if the term is supposed to be twenty years in state prison, then three years toward that amount should have less weight or credit than two years and ten months at Patton toward a total jail time of two years and ten months.  To read more about this issue, click on the following link.
