Do Community Property Principles Bar Inter-Spousal Theft?

If a wife takes what a husband considers his own, but is considered community property under California law and thus also the wife’s, did the wife commit a crime?  Can one be convicted, in other words, of stealing from oneself?  Put another way, is the wife committing theft of the husband’s one-half interest in the item?  To read answers to these questions, click on the following link, which summarizes a recent appellate court decision on this issue.
