Can Prop 47 Alter a Negotiated Plea Bargain?

The answer to the question posed above is yes.  While a negotiated plea bargain is a contract and a court, generally speaking, should not alter a plea bargain’s material terms, Prop 47 is not one party asking to modify the plea bargain.  Instead, it is the voters of California and Prop 47’s text unambiguously applies to convictions through plea bargains.  To read a summary of an appellate court decision challenging this issue, click on the following link.
