Is a Negligently Late-Filed Petition to Commit an SVP Barred?

What if a prosecutor files a petition to commit a person as an SVP on the same day as the person is released from prison?  Is the person in custody at the time?  Obviously, the answer is not, so should not the petition be barred?  The trial court ruling on the petition agreed that it was, but what did the court of appeal ruling on the same question say?  The answer is described and explained in the following article.  Click on the following link to read the article.
