Under Prop 47, Is Passing a Forged Check Shoplifting?

In the following case, a man with a lengthy criminal history forged a check and then walked into a U.S. Bank in Riverside to cash it.  The check was for $300.  The teller called the police and he was arrested.  He later pled to a felony for check forgery.  After Prop 47 was passed, he asked the judge to resentence him to misdemeanor shoplifting for this conviction and the judge agreed.  The People appealed the ruling.  How did the appellate court rule on this and why?  Click on the following link to find out.
