The new judicial diversion law, effective January 1, 2021, gives the judge discretion to suspend proceedings in any misdemeanor (except domestic violence (both 273.5 and 243(e)(1), stalking (646.9) and any misdemeanor where defendant, if convicted, would be required to register as a sex offender under Penal Code § 290), and order the defendant to a program of judicial diversion for up to two years.
